Terms and conditions of MycoMedica e-shop
These Terms and conditions apply to purchase of goods in www.mycomedica.cz, www.mycomedica.pl and www.mycomedica.sk e-shops.

Conclusion of the contract of saleAn order, properly filled and sent by the customer (the purchaser) represents the conclusion of the contract of sale between that person (the purchaser) and TCM POINT s.r.o. company (the seller).
After your order is received, we will send you a receipt confirmation by email. This confirmation is sent automatically and is only of informative nature and does not automatically represent the acceptance of your contract of sale proposal.
The contract of sale is deemed concluded if the seller does not contradict the proposal within 24 hours (this limit is extended during bank holidays and other non-working days by the length of their duration).
From that moment, mutual rights and obligations between the purchaser and the seller are established.
All contractual relations are concluded in accordance with the laws of the Czech Republic. As one of the contracting party is a consumer, the relations not covered by these terms and conditions are governed by the Civil Code (Act no. 40/1964, as amended) and the Act on Consumer protection (Act no. 634/1992, as amended).
Sending the orderCheck your order carefully before its final confirmation. The purchaser is responsible for filling in the order correctly as well as for the data needed to execute the order. If you agree with all information in the order, use the Send button to finally submit the binding order for execution. The sending makes the order firm. We will send an email with order confirmation to your email address.
Cancelling an orderA sent order can only be cancelled if it has not been executed and dispatched to the purchaser yet. Cancelling an order must be done by sending an email to objednavky@MycoMedica.cz address or by phone using the number +420 739454915. It is necessary to know the information about the order, its number and your identification data.
If it is not possible to cancel the order, you can return the intact goods, with no sign of usage or wear, back to the seller within one month, with no need to state the reason (see Return of goods).
Return of goodsIf you have decided that you no longer want the purchased goods for any reason, we provide you an extra option (in accordance with section 53, subsection 7 and section 54 of the Civil Code) to return the goods back within one month of its receipt, with no need to state the reason. Send the undamaged goods, with no sign of usage or wear, in its original packing, and the original or at least a copy of the invoice, back to us within the stated period – the decisive date is the date of dispatch back to the seller. Send the goods in a standard parcel only – cash on delivery parcels will not be accepted. After receiving your returned goods, we will return the respective amount of money to your bank account (within 30 days). Postage and packing fees will not be refunded.
Prices of goodsAll prices shown in our e-shop include the value added tax and they are valid at the moment of purchase.
Dispatching, delivery and payment for the delivery of goodsTogether with the goods, the seller will provide one copy of the invoice/tax document, which also serves as a delivery note and a warranty card.
The seller dispatches the goods on working days, usually within 1–5 working days, by handing it over to the carrier. The delivery period depends on the internal regulations of the carrier. In case some of the items are not in stock but they are expected to come soon, the dispatch time may increase by 1–7 working days above the standard dispatch time. In case some items are not in stock and they are not expected to come soon, we will contact you by email.
If not arranged otherwise, the goods will be delivered by Czech Post (Česká pošta a.s.).
The purchaser will receive the goods by post in an envelope or a parcel.
The payment needs to be sent in advance to our bank account (stated in the email with the payment request) or by cash on delivery (when sent by a carrier) or in cash (with personal pickup).
The parcels are deposited by the post office for up to 7 days.
You can also collect your goods personally in our consulting office at TCM POINT, Krásnohorké 672, Náchod. We will inform you about the term for pickup by email or SMS.
Receipt of shipmentBe extremely careful about the exterior packing. This means that you need to check the surface of the parcel or the envelope, the protective tape and all, even small damages and ruptures, especially punctures of the cardboard and deformed corners of the parcel. These symptoms may mean careless handling of the parcel during transport and possible damage of the goods inside. If you discover any of these or similar symptoms that may indicate a forced entry to the parcel or possible damage during transport, report this fact to the delivery person. Insist on writing a return report or a confirmed damage record that will state the condition of the parcel at the time of the delivery and describe other possible damages. This procedure will ensure smoother solution of later complaints and minimize possible financial damages.
PackagingThe seller is responsible for the compliance of all packaging materials of the delivered products with all relevant legal requirements. The package shows a full list of product ingredients and instructions for use. The text complies with the text approved by the state authority. The package always shows the best-before date of the product.
Every such email will also contain information explaining how to cancel receiving these emails.
The customer is at any time entitled to ask for deletion of this personal data from the database and for cancelling their registration.
By providing their data for registration, the customer agrees that the seller can process this data and use it for its internal and marketing purposes according to section 4, subsection e) of the Act no. 101/2000. This data will not be provided to third parties under any circumstances.
Final provisionsThe seller reserves the right to change and amend these conditions.
The Terms and conditions come into effect on 1 June 2011.
